COMPENSATION ACCIDENT
VICTIMS
ARE ENTITLED TO RECEIVE
If you were injured as the result of the negligence of another, you are entitled to receive compensation in the form of money damages. Compensation is determined by the type of injuries and damages sustained, subject to the limits of available insurance coverage and assets of the negligent party. In cases where the negligent party has inadequate insurance coverage or has no insurance, compensation may be available through your own insurance company under uninsured/underinsured motorist coverage, med pay, income protection and certain home owners’ policies. Compensation may include any or all of the following, depending on circumstances:
1. Pain and Suffering Damages
2. Payment for Physical Disability
3. Payment for Emotional Trauma
4. Payment of Reasonable and Necessary Medical Treatment
5. Payment for Future Medical and Support
6. Payment for Vehicle and Personal Property Damage or Loss
7. Loss of Use and Reasonable Rental Expenses
8. Loss of Income and Diminished Income
9. Loss of Employment
10. Payment for Disfigurement
11. Payment for Loss of comfort and Companionship
12. Payment for Inability to Participate In and Enjoy Customary Activities
13. Payment for Incidental Expenses; Prescriptions, Parking and Mileage
14. Punitive Damages in Certain Cases Only
Most personal injury cases are settled without filing a lawsuit or going to trial.
Many personal injury cases are settled within months of completing medical treatment, but no accident victim should consider settling his or her case until all injuries are resolved or until no further recovery can be anticipated.
California and Utah are both comparative negligence states, although different formulas for calculating comparative negligence are utilized by each state. Even if you were partially at fault for an accident, you may be entitled to receive compensation. Consult an attorney to determine if you have a comparative negligence claim worth pursuing.
If you are involved in a personal injury accident, always first contact a personal injury attorney before reporting the accident or talking to your insurance carrier.
